Article 1: Acceptance and Amendment of the
General Conditions of Sale
Any order placed on the www.avenue-colombie.com site implies that the
customer explicitly recognizes to have acquainted with present terms of
sale and accept them without reserve. Avenue Colombie reserves the
right to amend the present general conditions of sale at any time . In
case of modification, the applied conditions of sale to every order
will be the current ones the day of the order.
Article 2: Availability of products
All our offers are valid as long as they are visible on the site, and
this within the limits of available stocks. After validation of your
order, we verify the availability of product(s) ordered and send you a
confirmation. In case of shortage of stock on one of the products of
your order this message will ask you to validate or to cancel the rest
of your order.
Article 3: Validation of the orders and
electronic signature (law of March 13th, 2000 on the electronic
signature)
Any order form signed by "double click" constitutes an irrevocable
acceptance which can be questioned only in the limits planned in the
present general conditions of sale. The "double click" associated with
the procedure of authentification constitutes an electronic signature
having the same value as a handwritten signature. Computerized
registers, preserved in the computer systems of the company Avenue
Colombie in reasonable conditions of safety, will be considered as the
proofs of the communications, the orders and payments intervened
between the parties. The filing of order forms and invoices is made on
a reliable and durable support which can be produced as proof of
transaction.
Article 4: Prices
Avenue Colombie reserves the right to modify its prices at any time but
makes a commitment to apply the price rates which will have been
indicated to you at the time of your order, within the limits of
available stocks at this date. Indicated prices include VAT but exclude
carriage charges.
Article 5: Methods of payment and Security
of the transactions To pay for your purchases you have two
solutions:

by bank transfer to our account (Banque
Populaire des Alpes). We can provide banking information upon request.
Most banks now propose this e-service from your customer interface.
Your order will be treated after acceptance of your payment.

by credit card.  The payment by bank card
is directly made on the secure server of our bank (Banque Populaire des
Alpes). The details of your card are always encypted thanks to the
protocol SSL 128 (ATOS technology) when they transit on the network.
Avenue Colombie having no access to these details, they are asked of
you again in every new transaction on our site. Your order will be
recorded and taken into account from the acceptance of the payment by
our bank.
NB
: no debit
is made as long as your order is not delivered to the carrier « La
Poste ». A message will inform you about at this stage and will supply
you the follow-up number of your parcel. Products remain the property
of Avenue Colombie until the complete collection of the order. However,
after delivery, the risks of the delivered goods are transferred to the
customer. Avenue Colombie reserves the right to refuse to make a
delivery or to honor a order emanating from a customer with whom a
dispute of payment is not resolved.
Article 6:
Modalities of delivery - Destinations covered
Your order will be delivered to you by post, option "Colissimo Services
F" in Metropolitan France and Monaco and option "Colissimo Expert I" in
the following European countries: Germany, Austria, Belgium, Denmark,
Spain, Finland, Great Britain, Ireland, Italy, Luxemburg, Norway,
Netherlands, Portugal, Sweden and Switzerland. For other countries
please contact us.
Postal
charges
The shipping expenses of the order depend on the place of delivery, the
total weight and the amount of the order, independently on the number
of parcels, and are calculated with the order.
Modalities
of delivery
Parcels can be delivered to the address of your choice such as
indicated on the order form (only physical addresses allowing the
follow-up of the parcel are permitted and will be handed to you on
signing, to you or to any person named by you to postal services. In
case of absence your order remains available 15 days at the closest
post office. Possible delays do not give the right to the buyer to
claim for damages.
Delivery
periods Normally, your
order is prepared and sent within 1 working days following the day of
your order, to which the delays of routing by post are added, that is 1-2
working days for metropolitan France and 4-8 working days for the
rest of Europe. In case of leave as indicated on our welcome page please allow for one to a few additional days.
Damaged parcel
Upon delivery, if
the packaging is damaged, torn, opened, you have to check the state of
the products. If they were damaged, the customer must refuse delivery
and note a comment on the delivery note (refused parcel because opened
or damaged) and inform Avenue Colombie within 2 days, at
sav@avenue-colombie.com.
Misled Parcel
Since
most of our shipments are insured, we request that you inform us of any
delay with respect to delivery date given in the confirmation e-mail,
at sav@avenue-colombie.com. In this case, we will contact the Post
office to ask for an inquiry if necessary. If during the inquiry (21
days), the product is found, it will be automatically reshipped to the
original shipping address. If at the end of postal inquiry, the parcel
is not found we can send back to you a replacement product, at our
expenses, subject to availability, or you will be reinbursed the cost
of ordered products . Avenue Colombie will not be held responsible for
the non-fulfillment of the contract in the following cases: causes
beyond our control, disturbance or complete or partial strike notably
of postal services and means of transportation andor communication,
flood or fire.
Article 7: Right of retractation
In
accordance with trading standard legislation, you have 7 working days
as from the delivery date of your order, to request an exchange or
refund of any unsatisfactory item. Before returning to us whatever it
is, you should inform us by e-mail at sav@avenue-colombie.com, to
facilitate the handling of your returns. The product must be returned
to us in good condition, in its original packing, and unused, within 7
working days from the return agreement and at your expense. Having
received and accepted your parcel, we shall proceed within 15 days to
the refund.
Note
that in the case of free delivery, the offer is cancelled and costs
will be deducted from your refund.
Article 8: Disputes
The
choice and the purchase of a product are made under the responsibility
of the customer. The total or partial impossibility to use products
cannot be grounds for any compensation, refund or questioning of the
responsibility of the company Avenue-Colombie, except in the case of a
latent defect, a nonconformity, an imperfection or the use of the right
of retraction envisaged under the article 7. In case of a latent
defect, you have the choice between cancelling the order or keeping the
product against a price discount.
The present contract is
subjected to French law. Avenue Colombie cannot be held responsible for
damages of any kind, material, immaterial or physical, which could
result from a misuse of the marketed products. In case of difficulty in
the application of the present contract, you have the possibility,
before any action in justice, of looking for an amicable solution
notably by means of a professional association, an consumer association
or other advice of your choice. By default, the Commercial court of
Grenoble is the only competent body.
Article 9 : Law " informatic and liberty "
Collecting
nominative information for the purposes of mail order sales is
indispensable for the treatment and the routing of the orders, the
issuing of invoices and guarantees. Any piece of information lacking
implies the non validation of the order. In accordance with "Data
Protection Legislation ", the treatment of nominative information
concerning customers was the object of a statement with the National
Committee of Computing and Liberties (CNIL). At any time, you have a
right of access, modification, rectification and deletion of the data
which concern you (art 34 of the law " Computing and Liberties " of
January 6th, 1978). Following your order, we may advise you of special
offers and product information. You can also modify your subscription
at any time by sending an e-mail to contact@avenue-colombie.com.
Furthermore, Avenue Colombie will not divulge any information on their
customers to third party.
Article 10: Author's right
Any reproduction, complete or partial of the www.avenue-colombie.com
site is systematically subjected to the authorization of its owner.
